Questions on forensics?
Feel free to send an email or give a call on the capabilities of computer forensics.  It is good to know what computer forensics can do for you, but it is sometimes better to know what it cannot do.

It'll Never Happen to Me

 Consultants have been engaged in forensic litigation support where an employee had left his employ over a year earlier and sued for wrongful termination.  The former employer had reissued the employee's laptop and desktop.

There were no supporting documents (printed) available to support the employer and any information that may have existed on the computers, no longer was available as it had been reformatted, reinstalled, and overwritten. This was an expensive lesson for the employer, but one that won't be made again!

Non-Employee Issues

There are many reasons to keep computer forensics in mind during the normal course of managing your business.  These reasons include;

  • Compliance with Regulatory Statutes
  • Compliance with Litigation Holds
  • Audits
  • Due Diligence in Mergers & Acquisitions
  • Contract Disputes
  • Hacking incidents
  • Inadvertent release of protected or sensitive information

Some of the ways forensic processes can assist in these areas include ensuing that your employees have been maintaining compliance with litigation holds by auditing their workstations; conducting audits and due diligence in Mergers & Acquisitions to ensure buyers and sellers feel confident in their agreements; Contract Disputes in that the original emails and versions of the contracts can be recovered along with any metadata; among other high risk activities.

It is not enough to 'trust' that data is where it is supposed to be and not where it is not supposed to be.  Computer forensic processes can ensure that during a split of a high tech company, all IP stays where it is to stay as negotiated in contracts.

In regards to compliance to litigation holds, failure to ensure your company is in compliance can result in huge sanctions that could have easily been avoided.  e3 has the experience, ability, and knowledge to help guide you, your company, and explain high tech details to your legal counsel to avoid expensive, unnecessary fines by court.
