What Are The Penalties For A Maine DUI And How Much Does It Really ...
A first time offender (FTO), under age 21 and having a BAC (blood alcohol concentration) of less than .079 percent, will lose their license for one year. If there is a passenger in the vehicle who is also under age 21, add another 6 months to the suspension. If the FTO has a BAC of .08 percent or more, they lose their privileges for 1 year. Was there a passenger under 21? If so, you can add another 6 months to the suspension. Without aggravating circumstances, the maximum penalties that can be evoked are a $2,000 fine, 1 year in jail and one year of probation. Aggravating circumstance can include a multitude of things. It could mean driving 30 miles per hour, or more, over the posted speed limit, trying to elude the police officer, having a passenger under the age of 21 or having a BAC level of .14 or above. If you agree to a BAC test, the minimum penalties are as follows: three year suspension without a work license and three year registration suspension (2 year suspensions if under 21), 7 days in jail, and a $700 fine. Both can be reinstated after 9 months if you agree to having an ignition interlock device (IID) installed. (There is an installation cost associated with this device and maintenance costs for one of these units runs approximately $60 per month- all at your expense.) If you refuse a BAC test, minimums can jump to 12 days in jail and $900 fine, while suspensions remain the same. Note: An ignition interlock device (IID) is a mechanism that attaches directly to your car’s dashboard. Once installed, the driver is required to blow into a hand-held sensor for detecting alcohol before the car can be started. If the driver’s alcohol level exceeds the unit’s pre-set limit, which is typically between .02 and .04, the car will not start. You have now committed a felony, punishable by a minimum 6 year suspension of both your car registration and your license. There is also a minimum 30 day jail sentence and an $1,100 fine. Now, you have to go three years on your suspensions before you are eligible for an IID installation. Refuse a BAC test and your limits start at 40 days and $1,400 and go up from there. This is another felony. Now you are eligible for a six year suspension on your registration and license.
